Who Qualifies for DIC Benefits?

You may be eligible if any of the following apply to your situation.

Cause of Death Was Service-Connected

Your spouse died from a condition that was caused by or worsened by their military service, including Agent Orange presumptive conditions.

Veteran Was 100% Rated

Your spouse was rated totally disabled (100% or TDIU) for at least 10 continuous years before death, or for at least 5 years from discharge to death.

Death During Active Service

Your spouse died during active duty, active duty for training, or as a result of a service-connected disability.

Agent Orange and DIC: A Direct Connection

Many Vietnam veterans died from conditions caused by Agent Orange. If your spouse served in Vietnam and died from any of these presumptive conditions, the VA should approve your DIC claim.

Questions We Hear Most

How long do DIC benefits last?

DIC benefits continue for the lifetime of the surviving spouse, as long as they do not remarry before age 57. Remarriage after 57 does not affect benefits.

My spouse's death certificate doesn't mention Agent Orange. Can I still qualify?

Yes. The death certificate only needs to list the condition, not the cause. If your spouse had ischemic heart disease, cancer, or another AO presumptive, we can make the connection.

My spouse was rated 100% but the VA says the death wasn't service-connected. What now?

If your spouse was totally disabled for 10+ continuous years before death, you may qualify for DIC regardless of what the death certificate says. We can review your situation.

Does it cost anything to talk to you?

Can I also receive my spouse's accrued benefits?
